Terms of Service
By using Quest2Learn, you agree to the following terms.
These Terms of Service ("Terms") govern your access to and use of Quest2Learn ("Q2L," "we," "us," or "our"), including our websites, applications, and related services (collectively, the "Service"). By creating an account, signing in, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Who we are
Quest2Learn is an educational technology platform that supports teaching and learning through role-based access for administrators, teachers, and students. Features may include class management, learning activities (such as quests and quizzes), reading materials (including PDFs uploaded by teachers), pronunciation practice tools, announcements, calendars and notes for instruction, optional AI-assisted chat or tutoring features, and performance or skill-related analytics when enabled by your school or organization.
2. Eligibility and accounts
- You must provide accurate registration information and keep it up to date.
- You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.
- Student accounts may be created or provisioned by a school, teacher, or administrator. If you are under the age of majority in your jurisdiction, you may only use the Service with consent and supervision as required by your school, parent, or guardian and applicable law.
- Teacher and administrator accounts are subject to verification or approval processes we or your institution operate.
3. Acceptable use
You agree not to:
- Use the Service in violation of law, school policy, or these Terms.
- Harass, bully, threaten, or discriminate against others; post unlawful, hateful, or sexually explicit content; or share others' personal data without authorization.
- Attempt to gain unauthorized access to the Service, other users' accounts, or our systems; interfere with or disrupt the Service; or scrape, mine, or automate access except as we expressly permit.
- Upload malware, circumvent security, or overload infrastructure.
- Misrepresent your identity or affiliation, or use another person's account without permission.
- Use AI-assisted features to generate content that violates academic integrity rules established by your institution, unless explicitly permitted.
We may investigate violations and cooperate with schools and law enforcement where appropriate.
4. User content and materials
Teachers, administrators, or students may upload or submit content (for example, class materials, PDFs, text in quests, audio for pronunciation practice, or messages in chat). You retain ownership of content you own; where applicable, you grant us a limited license to host, process, display, and transmit that content solely to operate and improve the Service for you and your institution.
You represent that you have the rights to any content you submit and that it does not infringe others' rights. We may remove content that violates these Terms or law, or that we reasonably believe is harmful to the Service or community.
5. AI-assisted features
Some features may use artificial intelligence or machine learning (for example, through third-party APIs such as OpenRouter, Google Gemini, or similar providers when configured). AI outputs may be inaccurate, incomplete, or inappropriate. They are not a substitute for professional judgment, licensed instruction, or medical or legal advice. You are responsible for how you use AI-generated content in an educational setting and for complying with your institution's policies.
When you use AI features, portions of your prompts or related context may be sent to third-party processors as described in our Privacy Policy. Do not submit sensitive personal data or confidential information you are not allowed to share.
6. Third-party services
The Service may integrate sign-in or other features from third parties (for example, Google Sign-In). Your use of those services is also governed by the third party's terms and privacy policy. We are not responsible for third-party services outside our reasonable control.
7. Intellectual property
The Service, including its software, design, branding, and documentation, is owned by us or our licensors. Except for the limited rights to use the Service under these Terms, no rights are granted to you. You may not copy, modify, distribute, sell, or reverse engineer the Service except where law prohibits such restrictions.
8. Availability and changes
We strive to keep the Service available but do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue features with or without notice. We may update these Terms from time to time; we will indicate the "Last updated" date at the top. Continued use after changes constitutes acceptance of the revised Terms where permitted by law. If you do not agree, you must stop using the Service.
9. Termination
You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms, if required by law, or at the direction of your school or organization. Provisions that by their nature should survive (including disclaimers, limitations of liability, and governing law) will survive termination.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.
11. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, QUEST2LEARN AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (USD $100), IF NO FEES APPLIED.
Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the maximum permitted by law.
12. Indemnity
To the extent permitted by law, you agree to indemnify and hold harmless Quest2Learn and its affiliates from claims, damages, losses, and expenses (including reasonable legal fees) arising from your content, your use of the Service, or your violation of these Terms or applicable law.
13. Governing law and disputes
These Terms are governed by the laws applicable in the jurisdiction where Quest2Learn primarily operates, without regard to conflict-of-law principles, unless a mandatory law of your country provides otherwise. Courts in that jurisdiction will have exclusive venue for disputes, subject to any rights you may have under mandatory local law.
